These Terms and Conditions govern your use of the website https://www.katimckie.com and the services provided by Kati McKie Photography. By using our website and booking a photography session, you agree to comply with and be bound by these Terms and Conditions.

 

1. General Information

Kati McKie Photography is based in Barcelona, Spain. All services are provided in accordance with Spanish law, and we reserve the right to update or change these Terms and Conditions at any time. Please check back regularly for updates.

 

2. Booking and Payments

• Booking: To book a photography session, you must complete our online booking form or contact us directly via email. Bookings are considered confirmed upon receipt of a deposit or full payment, as specified on our website.

• Payment: Payments can be made via bank transfer, credit card, or other payment methods offered on the website. The payment terms for each photography session (including deposit requirements and final payment) will be communicated upon booking.

• Cancellation and Rescheduling: If you need to cancel or reschedule your session, please notify us at least 48 hours in advance. A cancellation fee may apply if less than 48 hours' notice is given. Rescheduling is subject to availability and may incur additional charges.

 

3. Photography Session

• Services Provided: Kati McKie Photography offers a range of services, including but not limited to portrait, event, and product photography. The details of the services provided will be outlined in the booking confirmation.

• Client Responsibilities: Clients are responsible for ensuring they arrive on time for their session and provide any necessary details, such as desired locations, themes, or special requests. If any required preparations are not made in advance, we cannot guarantee the desired results.

• Location and Equipment: All sessions will be conducted at the location agreed upon during booking. We reserve the right to use our professional equipment during the session. Clients are not permitted to use their own photography equipment unless prior written consent has been granted.

 

4. Copyright and Usage

• Ownership of Images: All images captured by Kati McKie Photography are owned by us. We reserve the right to use these images for promotional purposes, including on our website and social media, unless a prior agreement is made to exclude specific images from such usage.

• Client License: Upon full payment, clients will be granted a non-exclusive license to use the photographs for personal, non-commercial purposes. Commercial use, reproduction, or sale of the images is strictly prohibited without prior written consent from Kati McKie Photography.

 

5. Privacy and Data Protection

We take your privacy seriously and adhere to the European Union’s General Data Protection Regulation (GDPR) for the collection and processing of personal data. Your personal information will only be used for the purpose of providing services, communication, and administrative purposes.

6. Limitation of Liability

• Quality of Work: We strive to provide the best quality photography services; however, we cannot be held liable for circumstances beyond our control, including weather, natural disasters, or other unforeseen events that may impact the quality or outcome of a session.

• Liability: Kati McKie Photography is not responsible for any injuries, damages, or losses incurred during the photography session or while on the premises. Clients are responsible for their own safety during the session.

 

7. Refund Policy

• Deposit Refund: Deposits are non-refundable unless the session is canceled by Kati McKie Photography due to unforeseen circumstances. In such cases, a full refund will be issued.

• Full Payment: If the client is not satisfied with the final images, a request for re-shoot or edits can be made. Full refunds will not be issued if the client has received the agreed-upon services and images.

 

8. Force Majeure

Kati McKie Photography shall not be held liable for any failure or delay in fulfilling our obligations under these Terms and Conditions due to circumstances beyond our control, including but not limited to acts of God, war, strikes, or other events of force majeure.

 

9. Governing Law and Dispute Resolution

These Terms and Conditions are governed by the laws of Spain. Any disputes arising from or related to these Terms and Conditions shall be resolved through mediation or, if necessary, through the courts of Barcelona, Spain.
